Terms of Service
Effective date: October 5, 2026 · Version: v1.0 FINAL · These Terms govern use of pinksplay.world, a free-to-play social gaming platform with sweepstakes promotions featuring a full slots lobby (including blackjack and blackjack-themed slots).
1. Acceptance and changes
1.1 By creating an account or using pinksplay.world you agree to these Terms, the Official Sweepstakes Rules (Official Sweepstakes Rules, incorporated by reference), the Privacy Policy, Prize Redemption Policy, Responsible Social Gameplay Policy, and Refund & Chargeback Policy.
1.2 We may change these Terms prospectively with notice (in-app + email at least 14 days before material changes take effect). Continued use after the effective date constitutes acceptance. Material changes never apply retroactively to already-accrued redeemable SC except as required by law or regulator order (see Sec 15).
2. Eligibility; permitted states; one account
2.1 Age 21+. You must be at least 21 years old everywhere, with no exceptions. We verify age via a database age/identity check before any SC are credited and full Tier 2 KYC (government ID + selfie/liveness + residency verification + OFAC/PEP screening + W-9/TIN collection where thresholds apply) before first redemption.
2.2 Permitted states for SC. SC bonuses, SC play, and prize redemption are available ONLY while you are both (a) resident-verified in, and (b) physically located in, one of the 16 SC-enabled states in our published state list: AK, AR, CO, GA, KS, MO, NE, NH, NM, NC, ND, OR, SC, SD, TX, WI. All other states and DC are GC-only (social play only; no SC). Washington is excluded entirely — you may not register, purchase, or play from Washington even for GC.
2.3 One account. One account per person; household/device limits as stated in-app. Multi-accounting is prohibited (Sec 6) and grounds for suspension/forfeiture (Sec 7).
2.4 Verification. We may require residency proof, re-verification on travel or risk triggers, and OFAC/sanctions screening at onboarding and before prizes. Failure to verify blocks SC credit and redemption.
3. Gold Coins (GC) — social play only
3.1 GC are virtual coins for social play only. GC have no cash value, are never redeemable, never transferable, and confer only a limited, revocable, non-property license to play social games.
3.2 GC are sold in Gold Coin packages (including small-SC micro packages where the package is GC with a free SC bonus — SC are never priced). The full package price is the taxable sale of a digital good where applicable.
3.3 GC purchases are final except as stated in the Refund & Chargeback Policy (unused packages within 14 days, with associated free SC reversed; refunds where required for errors or unauthorized use).
4. Sweeps Coins (SC) — promotional entries; Official Rules control
4.1 SC are free promotional sweepstakes entries, never sold. SC may be obtained only free: as a bonus with GC purchases, on signup, via daily/login drops and social promotions, and via the free postal AMOE. Package displays lead with GC; SC are labeled "FREE bonus." No purchase is necessary to obtain or play SC.
4.2 SC use, 1x playthrough before redemption, prize value (1 SC = $1.00), minimum redemption (25 SC, cash/bank only; no gift cards at launch), caps, expiry, taxes, and winners-list process are governed exclusively by the Official Sweepstakes Rules. In case of conflict, the Official Sweepstakes Rules control for SC matters.
4.3 SC from all sources behave identically (equal dignity): same games, RTP, playthrough, and redemption rules. There are no purchase-only SC games.
5. Geolocation and travel
5.1 SC sessions require passing geolocation at login and at each SC session; VPN, proxy, emulator, and location-spoofing tools are prohibited. We keep geolocation logs as compliance evidence.
5.2 If you travel to a GC-only or excluded state, SC features disable automatically. Balances are preserved subject to expiry/forfeiture rules; redemption re-enables when you return to an SC-enabled state and re-verify, subject to Sec 15 wind-down windows.
6. Prohibited conduct
Prohibited conduct includes: (a) use of VPN/proxy/emulators or false location or residency information; (b) multiple accounts, shared devices/accounts to farm bonuses, or bonus abuse; (c) bots, scripts, scraping, collusion, or exploitation of bugs; (d) chargeback abuse or payment fraud; (e) sale, transfer, or gifting of GC or SC (no P2P); (f) crypto in/out to evade controls (no crypto redemption at launch); (g) marketing in non-SC states or to under-21 audiences on our behalf; (h) any unlawful use. Affiliates/influencers are additionally bound by the Affiliate/Influencer Terms (FTC disclosure, state-exclusion, prohibited claims).
7. Suspension, closure, forfeiture, and appeal
7.1 Suspension/closure. We may suspend or close accounts for suspected prohibited conduct, ineligibility, chargebacks pending review, or regulatory direction, with written reasons to the extent permitted by law.
7.2 Forfeiture limited. Forfeiture applies only for fraud, ineligibility, or material rule breach, with written reasons and an appeal route (appeal to compliance@pinksplay.world within 30 days; decision within 30 days). We never forfeit for responsible-gaming self-exclusion.
7.3 Payout on closure. On voluntary closure or regulatory state-exit, we pay out redeemable, KYC-verified SC per the Official Sweepstakes Rules and wind-down notice (at least 30 days to redeem verified balances). Unplayed/unverified SC and all GC are not paid.
7.4 Chargebacks. A chargeback suspends SC redemption pending review; associated free SC are reversed; repeated abuse leads to closure. No subscriptions or VIP auto-renewal at launch.
8. Purchases, refunds, and taxes on purchases
GC sales are processed by our payment providers; we do not hold customer funds as a wallet. Sales tax on GC is collected where digital goods are taxable via a tax engine. See Refund & Chargeback Policy for refund windows and unauthorized-use process.
9. Intellectual property; license; acceptable use
9.1 All games, software, trademarks, and content are owned or licensed by us. We grant a limited, revocable, non-transferable license to use the service for personal entertainment.
9.2 You grant us a limited license to display your username/gameplay as necessary to operate leaderboards and social features. Publicity involving winners requires separate opt-in consent (see Official Sweepstakes Rules).
10. Disclaimers and limitation of liability
To the maximum extent permitted by law, the service is provided "as is"; we disclaim implied warranties; our aggregate liability is limited to the greater of US$100 or amounts you paid in GC purchases in the 6 months before the claim, excluding liability that cannot be limited by law. Nothing limits AG/regulatory remedies.
11. Indemnity
You indemnify us against third-party claims arising from your violation of these Terms, the Official Sweepstakes Rules, or law.
12. Dispute resolution; arbitration; class waiver
12.1 Informal resolution first. Contact hello@pinksplay.world and follow the Complaints & Disputes Procedure (response SLAs, escalation to compliance officer) before filing any claim.
12.2 Binding arbitration. Except for small-claims matters and regulatory actions, disputes are resolved by binding individual arbitration administered by AAA under the Federal Arbitration Act. No jury trial. No class, collective, or representative actions; no private-attorney-general claims except where non-waivable by law. You may opt out of arbitration within 30 days of account creation by written notice to legal@pinksplay.world.
13. Governing law and venue
These Terms are governed by the laws of Virginia, without regard to conflicts principles, except where federal law or non-waivable state consumer/privacy law applies. Venue for any non-arbitrated matter is as stated in the arbitration provision or, if inapplicable, courts of competent jurisdiction in Virginia.
14. Privacy; communications; marketing consent
14.1 Our Privacy Policy (including state addenda and GPC honoring) governs data handling, including KYC IDs, selfie/biometric data, and precise geolocation with opt-in consent (see legal/04-privacy-rg-aml-summary.md).
14.2 Marketing email complies with CAN-SPAM (accurate headers, physical address, one-click unsubscribe within 10 business days). We do NOT send marketing SMS at launch; any future SMS requires express written opt-in, 10DLC registration, quiet hours, and STOP/revocation honoring per TCPA/mini-TCPAs.
15. Regulatory-change and state-exit clause
Any state may switch to GC-only (or to full exclusion) on 24–72 hours' notice due to new statutes, AG/regulator action, vendor demands, or adverse rulings — including expected 2027 sessions. On exit we: stop SC bonuses, notify affected users, and honor at least a 30-day redemption window for verified redeemable SC. We may also modify or end promotions only at defined promotion-period boundaries except where law requires immediate action.
16. Responsible play
Default daily/weekly/monthly GC purchase limits, self-set limits, cooling-off (24 hours to 6 weeks), self-exclusion (6 months / 1 year / 5 years / permanent, irrevocable during term), reality checks, and problem-gambling resources (e.g., 1-800-GAMBLER, NCPG) are in the Responsible Social Gameplay Policy. Limit increases (opt-up) take effect only after a cooling-off period. Marketing is suppressed for self-excluded users; no VIP targeting of at-risk players. The Responsible Social Gameplay program applies in ALL states, including GC-only states.
17. Accessibility; complaints; security
Accessibility target WCAG 2.2 AA with published statement and feedback channel. Complaints follow published SLAs with compliance-officer escalation and record-keeping. Security/PCI scope is minimized via hosted fields; incident response follows the internal IR plan with breach counsel.
18. Operator information; contact; no legal advice
18.1 The operator of Pinks Play World is PRH Services LLC, a Virginia limited liability company organized under the laws of Virginia, with registered address at 117 Smithtown Road Ashland VA 23005 and phone 804-842-4251. 18.2 Nothing in these Terms or the service is legal, tax, or financial advice. Prize taxes are your responsibility (see Official Sweepstakes Rules).
